This Addendum supplements the WeRescue Terms and Conditions ("Terms") and applies only to an organization that is a unit, department, or agency of federal, state, county, or municipal government ("Government Entity"). Where this Addendum conflicts with the Terms, this Addendum controls for that Government Entity's account. This Addendum does not modify any other provision of the Terms except as expressly stated below.

1. Why this Addendum exists

A Government Entity is frequently restricted by its own governing law from indemnifying a private company, or from submitting to the courts or law of a state other than its own, without legislative appropriation or authorization. Sections 12 and 14 of the base Terms were not written with that restriction in mind. This Addendum resolves it for verified government accounts, without changing the Terms for anyone else.

2. Indemnification (replaces Section 12, Government Entities only)

Section 12 of the Terms (Indemnification) does not apply to a Government Entity to the extent it would require the Government Entity to indemnify, hold harmless, or otherwise assume the liability of another party in a manner prohibited by, or requiring legislative appropriation under, the Government Entity's applicable state or local law. Each party remains responsible for its own acts and omissions to the extent permitted by applicable law.

3. Governing Law (replaces Section 14, Government Entities only)

For a Government Entity, Section 14 of the Terms (Governing Law) is replaced with: these Terms, as modified by this Addendum, shall be governed by and construed in accordance with the laws of the state in which the Government Entity is located, without regard to conflict of law provisions.

4. Everything else stays the same

All other provisions of the Terms - including Section 11 (Limitation of Liability), Section 15 (Dispute Resolution), and every eligibility, content, and account-conduct requirement - continue to apply to a Government Entity exactly as written.
